Monday November 19th the Appeals Court of the Second Judicial Circuit of San Jose annulled the previous sentence that had declared the strike of employees in the education sector illegal, and sent back the process to the Labor Court for a new analysis.

The strike of workers in the education sector which began September 10 was declared illegal on October 9, most educators of public schools have still not returned to their jobs, after 71 days of striking, waiting for the sentence to be firm. The judge had called the strike illegal considering that it was not a peaceful movement.

The resolution of the Appeals Court now makes the process even longer. The resolution, written by judge Bettzabé Gutierrez, who also took part of the recent decision declaring the strike of Recope workers legal, urges the court to “proceed, without further delay, in resolving the omissions pointed out at the moment of dictating the new resolution by the substance”.

The Appeals Court considered that the Labor Court did not justify properly the reasons to consider the strike as not pacific.

Labor unions are protesting the fiscal plan and the movement has cost millions of dollars in losses for the Government and the country.
